When you place an order for goods via our website, your order constitutes an offer to purchase goods from us. Where you order more than one item, your order comprises a series of offers for each item individually. After placing an order, you will receive an order confirmation email. This confirmation acknowledges receipt of your order but does not constitute acceptance of your offer. The contract between us is formed only when we dispatch the goods to you and send a shipping confirmation email.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our site. You agree to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. This site provides only a limited license to you to access and use the Services for personal, non-commercial purposes. You expressly acknowledge and agree that Brass Eye transfers no ownership or intellectual property interest or title in and to the Services to you or anyone else.

You agree to indemnify, defend, and hold harmless Brass Eye and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

14. Force Majeure

We will not be responsible for any delay or failure to comply with these Terms if the delay or failure arises from any event which is beyond our reasonable control. Such events would include, but are not limited to, fires, floods, earthquakes, storms, natural disasters, war, civil unrest, pandemics, acts of terrorism, or by reason of any act done pursuant to a trade dispute, or any failure of a third party’s obligations.

15. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Kentucky. Each party shall bear its own costs and expenses and an equal share of the arbitrators’ and administrative fees of arbitration.

Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law principles. Nothing in these Terms shall affect your legal rights as a consumer.

17. Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Any changes to these Terms will be effective for all new orders placed after the change is published on the site.

How did Brass Eye start?

It started with two friends in Chicago woodworking and hating the cheap, shitty safety glasses available and repairing vintage safety glasses to use instead. Then one friend bought a farm in the foothills
of the Appalachians and took those glasses with him.

He wore them as he mended fences, built forts and planted an orchard. His children began connecting those glasses with new
beginnings and hard work and it created a desire to share an iconic look for other craftsmen, professionals and parents to wear too.

Kids on the farm, he saw the need for other craftsman, parents and professionals to have an iconic look their kids could remember them by too.

So, he decided to start a new, old company. So other craftsman, designers, hobbyists, professionals and parents could have a
beautiful, quality safety glass to use, make memories with and hand down to others.

Something that could get worn over time, to develop its own special scrapes and patina, so that when your children wear them next, they feel like home.

What materials are used and where are these made?

The frames are made with industrial grade TR90 thermo-resin that is incredibly durable, flexible and lightweight.

We chose this resin instead of acetate (which we love for reading glasses) because it is light enough to wear all day but strong enough to last for years.

These glasses were inspired in Chicago, designed in the foothills of Appalachia and manufactured by hand in a close knit community in the PRC.

What is your return and exchange policy?

On the off chance our glasses aren’t the right fit or vibe, returns can be requested within 15 days of receiving your order through our dedicated return portal here (add shopify return hyperlink). 

All glasses and packaging must be in new, undamaged and unworn condition to be eligible for a return.

To use our return portal: simply follow the link, enter your order details, choose the reason for the return and select your preferred return method (refund or replacement). 

Please note, you are responsible for all return or exchange shipping charges and the cost of a return label will be deducted from your store credit or charged at the time of processing. 

Once your return is received, inspected and found in new and undamaged condition, you will receive a refund to your original purchase method.

What is your lifetime warranty policy?

Our lifetime warranty policy applies to all claims submitted. To submit a warranty claim, claims@brasseye.co. To be eligible for a claim, you must be the original purchaser of the eyewear, submit a receipt of purchase and mail the original product in question to us for warranty evaluation.

The lifetime warranty only applies to manufacturer defects and absolutely no warranties, refunds or replacements will be approved for user misuse, abuse, damage, destruction, neglect or lack of care.

So, if you run them over with your tractor or drop them on the driveway or hit them with an axe or leave them outside under hellish weather or shoot them with a gun or put them in a fire or lend them to a careless friend or in any other way shape or form cause the damage, that would obviously NOT qualify for a replacement.

But if we receive the item and the product itself has failed from a manufacturer error, we will absolutely approve your warranty and promptly send you a new pair!

How do I take care of my glasses?

After a hard day’s use, wipe them down, store them in their carrying case and place them in a place where they won’t get smashed, squished, kicked, bitten, stepped on, sat on, spit on or damaged in any other way.

In other words, when not using them, keep them safe but please don’t keep them secret.
